Studio Happy Story offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, products and services, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
SECTION 1 - ORDERING
Online shop orders
Orders can be placed in our online shop, an order form, by phone or email and will always be confirmed via email before being processed. Cakes and sweets available in our online shop can not be customised, changed or made a different flavour that is available. You can place a custom order, this will effect the price.
Wedding and custom cake orders
It is advised to place you custom cake order a minimum of 6 weeks in advance via the online form. We will contact you within 72 hours via phone of email.
SECTION 2 - PAYMENTS
Online shop orders are directed to be paid when placing your order. If payment is not received your order will not process. Orders booked via an invoice require a down payment of 50%. The remaining 50% is to be received three weeks before delivery/collection of your order.
We reserve the right to cancel any order still awaiting payment on the delivery date. Issuance and receipt of your invoice is taken as confirmation of your order and because we may have had to turn away other clients and start preparations for your order invoices will remain payable in the event of cancellation or postponement.
Invoices that are mutually agreed on to be paid after delivery, need to be paid within the communicated timeframe. If we’re need to send out a reminder, the first one will be at no extra costs. We’ll add an administration for more reminders. After the third reminder or 30 days we’ll give the invoice to a collection agency. Any extra costs will be your responsibility.
SECTION 3 - SHIPPING, PICKUP AND DELIVERY
Due to the nature of your product, we do not ship. You can pick up/collect your order or have it delivered by hand. All one-tier cakes are great for studio pickup. If arranging your own courier/in-person pickup we would advise always booking a van or car, rather than a motorbike. Instructions on how you can best transport your cake are available on http://www.studiohappystory.com/howtos. Once cakes have left our bakery we can not be held liable for any damage that occurs in transit. Any issues should be handled directly with the courier company/person you have chosen to use.
If pickup dates are not available in the selection menu, we are either fully booked or that date is no longer available. Pickups are on Friday between 9am-12pm or 4pm-6pm or Saturdays between 9am-12pm. If you need a cake for Sunday, you’ll need to pick it up on Saturday. Deliveries are on appointment and not subjected to fixed days.
Deliveries are made by hand on the date specified in your order. All deliveries are undertaken by Studio Happy Story or our couriers. Please ensure someone is available at the delivery address on the day of your order; if there is no-one on hand to receive the order we will do our very best to leave it in a safe place (with a neighbor, receptionist, caretaker, etc.) but we cannot keep hold of the order for re-delivery and they will be left at the address you have given us. If you would like us to deliver to your place of work or somewhere with a mailroom/courier point we are happy to do so but please note that Studio Happy Story cannot accept any liability for the treatment of your order or mishandling once a delivery has been made and the package/s signed for. All our drivers are instructed in the correct handling of the order and will always pass this information on to any postroom workers but once the order is signed for we cannot accept liability for the subsequent handling of your cakes/sweets.
SECTION 4 - DESIGNS
For wedding & custom cakes we provide a design sketch after a down payment is made. Changes to the original design are possible up to 3 weeks before the delivery date; must be submitted in writing and are subject to availability. Keep in mind that this can lead to extra costs.
We will never duplicate other work. You can submit photos during the design process to illustrate your wishes and we’ll come up with a design that represents your wishes. This makes every cake unique. During the decoration process, we reserve the right to make any last-minute changes to the small details to guarantee the quality standard of its products. Design colors are only guaranteed if color samples have been supplied by the customer. If this is not the case, Studio Happy Story will put together the color to suit the design according to its own insight. Keep in mind that the medium is food.
The customer is responsible for removing all non-edible decoration including dry sugar decorations (such as flowers) from the cake before it is cut and eaten. Dry sugar decorations are made from edible ingredients, but not intended for consumption.
SECTION 5 - FLAVORS AND INGREDIENTS
If for some reason a flavor that you have chosen is no longer available, we’ll notify you and ask you to choose another one. However, this is not a reason for a discount. We work with basic ingredients that can be seasonal subjective to change. Our products may contain or have been in contact with milk, grains, nuts, cocoa or other allergens. Although we take care of indicated known allergies, it remains the responsibility of the customer to inform the guests. We are not responsible for possible allergic reactions.
SECTION 6 - REFUND, CANCELLATIONS AND COMPLAINS
All our cakes and sweets are baked to order and we do not accept returns. Refunds, credit notes or a replacement order to the same value will be given only in the event that you receive the incorrect product or if the products are shown to be of unsatisfactory quality. Should this be the case, or if you are in any way unsatisfied with the condition or quality of your cakes upon arrival you must contact us within 24 hours of receipt. Studio Happy Story will not accept liability for any complaints made after this time.
If you need to change the date or details of your order or cancel it altogether please contact us as far in advance as possible. Phone and online orders canceled 7 days or more before the delivery/collection date will receive a full refund on the order total; those canceled within 3-6 days of delivery/collection will be entitled to a 50% refund; those canceled within 48 hours of the order date will not be entitled to a refund (although refunds and credit notes may still be provided at SHS’s discretion).
Customers who have booked and received an invoice from Studio Happy Story are entitled to a full refund on the order total for cancellations made 28 days or more in advance of the order date and a 50% refund for orders canceled within 7-27 days of the order date. Orders canceled within 7 days of delivery/collection will not be entitled to a refund (although refunds and credit notes may still be given at SHS’s discretion).
SECTION 7 - OTHER SERVICES
Services that are invoiced per hour (including freelance, dessert hosting, event management) it can happen that extra hours are being worked. If this threatens to happen, this will be indicated at the time of the event. For this, written approval must be given by authorised personnel. If you do not agree with this, we reserve the right to directly stop the work after the hours hired.
SECTION 8 - INTELLECTUAL PROPERTY
We reserve the right to use photographs of orders we prepare on our website, blog and social media pages for promotional purposes with our compensation. If you would like to specifically request that we do not use pictures of your order, or that we provide you with a picture of your order we will usually be happy to do so but you must let us know at the time of ordering.
Cake designs remain the property of Studio Happy Story and may under no circumstances be reproduced or duplicated without our written permission.
If Studio Happy Story catches you or third parties engaged by you for infringement of the intellectual property, Studio Happy Story has the right to compensation for infringement of its rights of at least three times the agreed fee, at least a compensation that is reasonable and reasonable in proportion the infringement committed, while maintaining the right of the designer to claim compensation for the damage actually suffered.
